The College of Law at Al-Nahrain University discusses Phd dissertation of Mr. Hassanein Abdul Wahid Hassan, a student in the Department of Public Law, entitled “The Legal Regulation of Voluntary Retirement Insurance in Iraq: A Comparative Study.”

The study addresses one of the modern systems incorporated within the Social Security and Pension Law for Workers No. 18 of 2023. It examines mechanisms for expanding social protection coverage to include self-employed individuals, employers, and workers in the informal sector, while analyzing the adequacy of legal provisions in addressing the shortcomings of previous legislation in accordance with international standards and constitutional principles. The dissertation reveals the unique organizational nature of this system as an independent branch possessing financial and administrative autonomy within the broader framework of social security.

The discussion also reviewes a number of legislative challenges related to the ambiguity of certain benefits and methods of calculating them, as well as the timeframes required for deciding on subscription applications. The researcher presentes several proposals, including reformulating the legal definition of voluntary retirement, specifying income categories, and determining state contribution rates in a manner that ensures financial balance, flexibility for subscribers, and the stability of their legal status.

The study seeks to support legislative reform efforts and provide an academic reference that contributes to the development of social security systems in Iraq, in addition to enhancing legal awareness of the rights of private-sector workers and advancing specialized studies that address current social and economic challenges.
